Article 2 β Object
These Specific Hosting Terms are intended to define the technical and legal conditions governing hosting services provided by INFRA NFC for the benefit of the Client within the framework of the use of the SaaS Platform.
2.1. Services provided by INFRA NFC
Within the framework of the subscription taken out by the Client, INFRA NFC ensures the hosting of data and work environments of the Client, under the following conditions:
- Hosting of Platform data in data centers located in France or Europe, operated by OVH Cloud.
- Provision of a shared and secure infrastructure allowing 24/7 access to the Platform.
- Performance of regular internal backups (technical backups), solely for the purposes of service continuity and maintenance.
- Infrastructure monitoring and intervention in case of technical incident affecting the global availability of services.
2.2. Important clarifications
The hosting offered by INFRA NFC does not constitute a custom or dedicated hosting service.
Consequently:
- The Client does not have access to the physical or virtual servers used by INFRA NFC.
- The Client does not have the possibility to freely choose the location or precise technical characteristics of the hosting.
- The backups performed by INFRA NFC have the sole purpose of ensuring technical continuity of services, and cannot in any case substitute for the Client's own backups (data exports, downloads, etc.).
2.3. Infrastructure provider
The hosting of Platform services is subcontracted to OVH Cloud, a simplified joint-stock company with a capital of β¬10,174,560, registered with the RCS of Lille under number 424 761 419, whose registered office is located at 2 rue Kellermann β 59100 Roubaix β France.
The Client expressly acknowledges and accepts that the data they record via the Platform are hosted on OVH infrastructure, under the technical and operational responsibility of INFRA NFC.
2.4. Service exclusions
The hosting services provided by INFRA NFC do not include:
- Specific administration of Client data or environments;
- Personalized backup or restoration of data at Client's request;
- A personalized business continuity plan (BCP);
- A contractual availability guarantee superior to that provided for in the following article.
Article 3 β Service access, use and availability conditions
3.1. Service access
Access to Platform hosting services is open to the Client from the creation and activation of their User Account, subject to:
- Having correctly subscribed to a valid subscription;
- Having provided the exact required information;
- Respecting these Specific Terms and the General Terms of Use (GTU).
Access to the service is via an internet connection, under the sole responsibility of the Client.
3.2. Service availability
INFRA NFC implements all reasonable means to ensure continuous availability of hosting services and the Platform.
However, INFRA NFC cannot guarantee uninterrupted service availability, this depending notably on:
- Technical constraints related to OVH hosting infrastructure;
- Planned or corrective maintenance operations;
- External events, independent of its will (force majeure, cyberattack, etc.).
As an indication, INFRA NFC strives to ensure an annual availability rate greater than or equal to 99.5%.
3.3. Maintenance and planned interruptions
INFRA NFC reserves the right to temporarily interrupt access to all or part of the Platform, notably to perform maintenance operations, updates, or improvement work. Where possible, INFRA NFC will inform the Client in advance of any planned interruption.
3.4. Access suspension
INFRA NFC reserves the right to suspend the Client's access to hosting services, without compensation, in case of:
- Major technical incident requiring urgent intervention;
- Use of services contrary to these conditions or applicable laws;
- Delay or default in payment of amounts due by the Client;
- Proven threat or attempt to compromise the security or integrity of the infrastructure.
In all cases, INFRA NFC will endeavor to inform the Client as soon as possible of the reasons and estimated duration of the suspension.
Article 4 β Data security and backups
4.1. General security measures
INFRA NFC implements, within the framework of an obligation of means, technical and organizational measures intended to ensure the security of the Platform hosting infrastructure, and notably:
- Securing physical and logical access to OVH infrastructures;
- Continuous monitoring of servers;
- Protection against known external intrusions and attacks;
- Regular updating of operating systems and software components used.
4.2. Client responsibility
The Client remains solely responsible for:
- The conservation and confidentiality of their access credentials;
- The data they integrate, store or process within the Platform;
- Performing, at their convenience, their own exports or personal backups via tools provided by INFRA NFC.
The Client undertakes to use the services in compliance with applicable laws and regulations, and not to host or transfer illicit or contentious content via the Platform.
4.3. Technical backups performed by INFRA NFC
INFRA NFC performs, as a preventive measure, regular technical backups of data hosted on the Platform, intended to ensure service continuity in case of major technical incident.
To this end:
- Backups are performed automatically and periodically;
- Their frequency is generally daily;
- Their retention period is 7 rolling days;
- These backups have strictly internal use and are not intended for individual client use.
INFRA NFC cannot be held responsible for data loss resulting from:
- A failure of the Client's equipment;
- An incorrect action or manipulation error by the Client;
- An external incident independent of its will.
4.4. Limitation of backup services
Except for subscription to a specific complementary service (on quote), INFRA NFC does not provide:
- Data restoration at Client's request;
- Provision of individual backup copies;
- A personalized business continuity plan (BCP).
